Zusammenfassung Was ist aus der Idee einer funktionsfähigen internationalen Strafgerichtsbarkeit geworden, die in den 1990er Jahren die völkerrechtspolitische Diskussion beflügelte und ihren Höhepunkt 1998 im Römischen Statut fand? Was wurde seither erreicht und wo liegen Defizite? Wie kann der Internationale Strafgerichtshof in einer Welt überdauern, in der sich autokratisches bzw. imperialistisches Denken und Geopolitik festgesetzt haben, während Demokratie und Menschenrechte auch in Europa unter Druck geraten sind? Fast 25 Jahre nach Inkrafttreten des Römischen Statuts am 1. Juli 2002 unternimmt der Beitrag eine Bestandsaufnahme des Internationalen Strafgerichtshofs bzw. des Völkerstrafrechts. Er fragt aus kriminologischer und rechtspolitischer Sicht nach den Errungenschaften und fortdauernden Problemen und markiert die offenen Fragen. Dabei kommen sowohl völkerstrafrechtliche (Strafzwecke, Strafzumessung, Strafvollzug) als auch kriminologische Aspekte (Theorien, Selektivität, Machtfragen) zur Sprache. Am Schluss steht die Erkenntnis, dass es nach wie vor darum gehen muss, das Erreichte zu verteidigen, damit das Recht das letzte Wort hat – und nicht nackte Gewalt oder Einschüchterung.

Zusammenfassung Der Völkermord hat trotz seiner tiefgreifenden Auswirkungen bislang die Kriminologie nur unzureichend beschäftigt und stellt ein Forschungsdesiderat dar. Um dieses Defizit aufzuarbeiten, wurde untersucht, ob und welche Informationen internationale Urteile zu Genoziden liefern. Der Beitrag untersucht folglich, welche Handlungsmuster und Erklärungen in drei wegweisenden Urteilen zum Völkermord erkennbar sind. Die Ergebnisse zeigen, dass in allen Fällen vor und während der Gewalttaten eine gezielte Entmenschlichung der Opfer stattfand, kombiniert mit einer konstruierten Bedrohungsassoziation, die Taten in Regimen ohne wirksame Kontrollinstanzen begangen wurden und dass der Genozid koordiniert-arbeitsteilig organisiert war. Diese Befunde verdeutlichen, dass Genozide auf mehreren Ursachen beruhen und systematisch ablaufen. Der Beitrag diskutiert die Aussagekraft und Grenzen juristischer Urteilsdokumente als Datenquelle der Genozidforschung und plädiert dafür, dass gerichtliche Urteilstexte eine fundierte Grundlage bieten kann, um den Genozid als komplexes Phänomen besser zu verstehen. Damit trägt die Arbeit zu einem vertieften phänomenologischen Verständnis des Völkermords bei und skizziert neue konzeptionelle Perspektiven.

Criminal justice investigators of atrocity crimes work in the same space as Non-Governmental Organisations. Even if having different objectives and mandates in crisis zones, numerous NGOs are also investigating or collecting evidence in the process of pursuing their other mandates, as was observed recently in Ukraine or Rohingya refugee camps. This can cause problems for the investigators of international crimes, and their work of collecting evidence on atrocity crimes in these contexts. This study is based on semi-structured interviews with sixteen experienced investigators from international and national justice institutions. Investigators raised this issue and discussed both benefits and problems of NGOs collecting evidence on atrocity crimes in conflict zones. A thematic analysis was conducted. In the results, investigators acknowledged positive effects of NGOs, such as their ability to quickly begin their operations, gather evidence and identify witnesses. Three problems and challenges of NGO involvement in the field were identified. First, NGO interviews do not always focus on establishing the facts and seeking accountability. Second, NGO involvement often meant that witnesses were interviewed multiple times, leading to inconsistencies in testimony and confusion. Third, NGO methods to interview witnesses can reduce the quality of evidence, for example by allocating insufficient time for thorough questioning, interviewing groups of witnesses simultaneously, or employing suggestive questioning techniques. Investigators described strategies for how they dealt with these problems, and recommended changes to the activities of NGOs. The findings underscore the need for improved collaboration between NGOs and justice institutions to safeguard the well-being of witnesses and the integrity of witness evidence on atrocity crimes.

Once the tide of the war began to turn in their favor and the enormity of the crimes of the Axis powers became apparent, the Allied powers of World War II agreed that after their victory, those responsible should be prosecuted. They even agreed on which crimes should be prosecuted in such proceedings. Almost no attention, however, was given to the issue of sentence enforcement. Thus, even as the wheels of the Allies’ war-crimes tribunals in Europe and the Pacific were put in motion, there was no general plan regarding how to run the institutions where the war criminals would serve their sentences. In this article we present some preliminary conclusions of a research project that took a detailed look at the three most important prisons for WWII war criminals: Spandau, Landsberg, and Sugamo. Though the victorious powers faced similar legal and practical problems in the administration of all three institutions, the solutions they found differed considerably. The most significant common feature of the respective systems they established is their improvised nature.

This article examines harms and reparations in Kosovo, based on interviews conducted with survivors in Prishtina and Gjakova. Using a reparative justice lens, I identify multi-layered harms-material, psychological, social, symbolic-and trace how needs evolved over time. Deportations in Prishtina and killings and disappearances in Gjakova illustrate both common and site-specific patterns. I show how Kosovo’s existing reparations schemes remain selective, opaque, and poorly aligned with survivor priorities. Centering survivor narratives, I propose a survivor-led framework that integrates material, symbolic, psychosocial, and institutional reforms. The analysis adds to discussions on transitional justice by showing how reparations can move from basic state obligations to shared, community-driven efforts for recovery.

Two narratives – of victimhood and perpetration – in Bosnia and Herzegovina (BiH) go hand in hand. They overlap, blend, intertwine, and, as I will argue, deepen polarisation among and between the main ethnic groups, rather than help bridge the societal divide, which appears to be deeper than ever since the end of the armed conflict in 1995. In this essay, I will reflect on what I saw, felt, and heard during my regular visits to Banja Luka, my hometown and the administrative centre of Republika Srpska, Bih. I will use my latest visit as a backdrop to tell the broader story of fragile transitional justice processes in BiH, and beyond.
