Les conséquences de la francophonie dans la pratique et l’enseignement de la traduction juridique

Abstract

In the practice and teaching of specialized translation – and especially in legal translation –, the concept of francophonie is vitally important. The existence of several legal cultures which have the French language as the vehicular language poses problems of different nature for both the practice and teaching of legal translation. Therefore, two scenarios are frequently generated by this reality: on the one hand, the production of legal documents written in French and valid solely in the legal system from which they emanate (i.e., one single language, several legal cultures); on the other hand, the use of certain words or legal expressions in French which acquire different legal meanings or nuances according to the legal system in which they are used. Both situations require the knowledge of such differences, the command of the legal language in contact with the legal system and the capacity of knowing how to choose and discriminate the relevant documentation in accordance with the legal context. The aim of this paper is thus twofold: firstly, we shall endeavour to expose what predicaments are caused by the aforementioned situation in the practice of legal translation, be it from an academic or professional viewpoint. Secondly, examples stemming from the practice and teaching of legal translation will be offered in order to illustrate these difficulties with regard to translation.
