Abstract

Robert Musil’s novel The Man without Qualities treats diminished responsibility as a problem shaped by two discourses, the legal discourse surrounding criminal-law reform and the discourse on forensic psychiatry and criminology. After first tracing these discourses in the nineteenth and early twentieth centuries with reference to F. von Liszt,G. Radbruch, E. Kraepelin,K.Wilmanns, E. Bleuler, and others, the seventy-fourth chapter of the novel is analysed against the background of moral-philosophical and legalphilosophical debate. The dispute between Ulrich’s father and his colleague Professor Schwung concerning the wording of the law on diminished responsibility also relates to the case of the murderer Moosbrugger, which is situated at the intersection of legal and psychiatric discourse. This case cannot be subjected to general rules; it reveals the problems associated with the consolidation process of individual disciplines. It also highlights the problems of translation between different disciplines. The novel employs a technique that interrelates different areas of expert knowledge with one another and is therefore not merely a presentation of that knowledge.
