Sununary

Relative clauses in Juridical Latin are strictly connected with the succession of subjunctive and indicative mood and with the use of demonstrative and determinative pronouns. Regarding the first point, we observed that the Opposition between indicative and subjunctive mood often expresses the Opposition between factual and non-factual utterances. Subjunctive mood is also more frequent in the second part of the responsum where the jurist expresses his own opinion (so he does not assume his communicative responsibility), whereas the exposition of the particular case often presents relative clauses with indicative mood. In the same way our jurists (Alfenus Varus and lavolenus), purposely use at a very high rate the determinative pronoun is, ea, id, that has not a deictic force. In fact they often have to switch, in their responsa, from the specific case (that it is to say from the particular case) to the general one, to the universal case. On the contrary deictic pronouns, that occur at a very low percentage, are always used to localize something in a specific place and time and they are usually employed during the description of a particular Situation.
