In this review article, I offer an overview of research undertaken thus far on early Mālikī Manuscripts, primarily the collection from Kairouan, Tunisia. Modern attention to this collection dates from the early twentieth century, as the collection itself moved from Kairouan to Tunis and back again. While access to Qurān manuscripts has been highly restricted, select scholars had been allowed to study and make copies of a limited number of legal manuscripts, primarily from the Mālikī school of Islamic law. These limitations had an effect on scholarship, making some forms of codicological and paleographic analysis difficult at best. The last part of the article addresses very recent scholarship and work that remains to be done, including network analysis and other ways of placing these manuscripts within broader social and historical contexts. I close with a reflection on the colonial history of research into these manuscripts and the responsibilities of researchers to reflect on the ethical implications of their activities into the future.

Résumé La constitution des écoles doctrinales de droit à partir du IV e /X e siècle conduit les juristes à entreprendre un processus d’harmonisation de leurs doctrines juridiques. Au sein du maḏhab mālikite, l’opinion qualifiée de mašhūr apparaît comme celle possédant le plus haut degré d’autorité. Les contours de cette notion ne sont cependant pas clairement définis et ont largement évolué au fil des siècles. Cet article entend se concentrer sur la période d’introduction et d’émergence du mašhūr au sein de la littérature juridique mālikite du milieu du IV e /X e au milieu du VI e /XII e siècle. Par le dépouillement de vingt-cinq ouvrages mālikites et l’analyse d’une dizaine d’occurrences du mašhūr , nous montrons qu’il est un outil juridique témoignant de l’évolution du mālikisme d’une communauté juridique d’interprétation en une véritable école de droit. En nous concentrant sur l’usage que fait Ibn ʿAbd al-Barr (m. 463/1071) du mašhūr – dont neuf occurences extraites de son Kāfī sont traduites en annexe – nous mettons finalement en évidence le fait que cet outil sert tant à reconnaître qu’à édifier l’autorité juridique d’Ibn al-Qāsim (m. 191/806), un des disciples de Mālik b. Anas (m. 179/795), au détriment de ses contemporains dans un contexte de profonde recomposition de toutes les formes d’autorité en Occident musulman.

This article approaches Qāḍī ʿIyāḍ b. Mūsā’s contribution to the stabilization of Mālikīsm in the Islamic West through his characterization of three important Andalusī figures of the school: Ibn ʿAbd al-Barr, Abū l-Walīd al-Bāǧī and Abū Bakr al-Ṭurṭūšī. ʿIyāḍ’s biographies of these scholars in two of his works, Tartīb al-madārik and al-Ġunya , are compared with those of Ibn Farḥūn (d. 799/1397) in his al-Dībāǧ al-mu d hab. These biographical dictionaries, Tartīb and Dibāǧ , are the two main sources for the pre-modern history of Mālikīsm. The results of this comparison go beyond an analysis of Iyāḍ’s contribution to the stabilization of the Mālikī school in the Maghrib. The strong dependence of the Dībāǧ on the Tartīb reveals Ibn Farḥūn’s vision of his great Maghribī predecessor which in turn forms an interesting intra-history of Mālikīsm worth preserving. Using Ibn Farḥūn’s Dībāǧ as a point of comparison also helps us to observe how the circumstances projected by the Tartīb evolved over time and space thus contributing to a better understanding of the process of doctrinal stabilization and social normalization of the Mālikī ma d hab West but also East. After introducing ʿIyāḍ’s facet as a historian and a biographer in Section 1, I present his biographies of the three selected scholars. In Section 3, I discuss the main differences in the way ʿIyāḍ and Ibn Farḥūn approached each of their contributions to Mālikīsm to wrap up the significance of these differences in the conclusions.

Résumé Les Nukat al-Maḥṣūl constituent le dernier des trois traités de théorie légale ( uṣūl al-fiqh ) écrits par le Qāḍī Abū Bakr b. al-ʿArabī (m. 543/1248) et surtout le seul à nous être parvenu. S’il est traditionnellement affilié au mālikisme, il ne faut pas oublier que la pensée légale du Qāḍī s’est construite en Orient et a été influencée par celle de maîtres appartenant à d’autres écoles juridiques ( maḏhab pl. maḏāhib ), tels le ḥanbalite Ibn ʿAqīl (m. 513/1119), et surtout le šāfiʿite Abū Ḥāmid al-Ġazālī (m. 505/1111). Cette tendance à l’éclectisme, interprétée a posteriori comme un penchant pour l’effort de déduction ( iǧtihād ) , traverse le texte des Nukat, ce qui nous amène à nous demander si celui-ci est vraiment un traité d’ uṣūl al-fiqh mālikite. Le présent article vise donc à examiner la place de ce texte dans la tradition mālikite andalouse, en l’analysant à la lumière des éléments caractéristiques de l’école juridique, telle la pratique des Gens de Médine ou la considération de l’intérêt public ( maṣlaḥa ) dans la déduction juridique. Ceci permettra par la même occasion d’apporter un éclairage sur la pensée légale d’Ibn al-ʿArabī.

Résumé En ce qui concerne la prière du vendredi ṣalāt al-ǧumu‘a , le maḏhab mālikite recommande un certain nombre de règles qui ne sont pas toujours applicables dans l’environnement saharien. La question abordée dans cet article est celle de l’élaboration d’une jurisprudence qui accorde les conditions de validité de la prière communautaire préconisées par le madhhab aux spécificités de la vie au désert. Elle est examinée à travers le recueil d’un juriste du Tafilalt du XVe siècle, Ibn Hilāl al-Siǧilmāsī (m. 903/1498). L’étude des compilations touaties des XVIIIe-XIXe siècles permet ensuite de mettre en évidence la stabilisation d’une jurisprudence soucieuse à la fois de la doctrine et de la vitalité des pratiques religieuses.

This article analyzes how the currently known West African fatāwā up to the 11th/17th-century, namely the rulings by Maḥmud b. ʿUmar b. Muḥammad Aqīt, Maḫlūf al-Balbālī and Aḥmad Bābā al-Tinbutkī, portray the sale of free Muslims ( bīʿ al-aḥrār ) in the premodern Sahel. It argues that the strong contradictions between Aḥmad Bābā al-Tinbuktī’s Miʿrāǧ al-ṣuʿūd and his previous legal replies to Yūsuf al-Īsī may justify to affirm that these Aǧwiba were not authored by the Timbuktu scholar, and suggests that the reasons for their elaboration and their attribution to him may be related to the interests of traders from the Maghreb, where the manuscripts of the Aǧwiba were found and the Replies supposedly emitted. This study brings forward the hypothesis that the aim of the text may have been to reduce the impact that the extraordinary measure of accepting the enslaved person’s qawl when declaring to have been illicitly captured at times and places where the sale of unenslaveable persons is attested, found in the Sahelian rulings but also in preceding Andalusi and Maghrebian rulings, could have probably caused in putting the indiscriminate sale of West African captives into question. This would also imply the existence of voices against their sale, probably because the adherence to Islam of the enslaved persons must have been clearly manifest.

ʿAmal (judicial practice) is a critical feature of post-classical Mālikī law in the Maghrib. The scholars who have examined ʿamal contend that it presents a paradigm of Mālikī law’s flexibility and judicial responsiveness to custom ( ʿurf ). However, ʿamal also constitute a significant part of the regional Islamic juristic literature produced from approximately the 17th to nineteenth centuries. In this article, I examine how ʿamal of Fez became not only widely practiced but part of the mainstream Mālikī jurisprudential discourse in Morocco. I argue that understanding Islamic law’s mechanisms for discursive stability is critical for its well-established capacity to change through principles like ʿamal . I do so by analyzing three practices that contravened the prevailing Mālikī rule yet were widely practiced as ʿamal of Fez: female witnesses for spousal defects, the ṣafqa unilateral shared property sale, and the lafīfiyya twelve-person testimony (plus a fourth “counter-example,” the abandonment of the mutual spousal cursing oath ( liʿān ), that reinforces the argument). I pay special attention to jurists’ discursive techniques for entrenching ʿamal in Mālikī history and precedence in classical substantive Mālikī rules. In the end, I call to acknowledge ʿamal ’s inextricable status as Islamic law in Morocco and beyond.

Résumé L’objectif de cet article est d’expliquer l’essor récent du mālikisme francophone par des dynamiques internationales, multiples mais connectées, alimentant un maḏhabisme renouvelé sur la scène internationale. Il s’agit d’être attentif au triple phénomène de la médiatisation, du déploiement des structures éducatives et de l’édition de livres islamiques inscrits dans le référentiel mālikite. Il apparaît, après analyse, que des logiques de réseaux transnationaux sont relayées par de jeunes acteurs francophones en passe de devenir à leur tour des autorités au sein du paysage islamique français.
