Zusammenfassung

Das Gesetz über genetische Untersuchungen bei Menschen (Gendiagnostikgesetz – GenDG) ist am 1. Februar 2010 in Kraft getreten. Es gilt für genetische Untersuchungen und Analysen zu medizinischen Zwecken, zur Klärung der Abstammung, im Versicherungsbereich und im Arbeitsleben. Der Gesetzgeber regelt die rechtlichen Voraussetzungen für die Durchführung genetischer Untersuchungen von der Aufklärung über die Einwilligung bis zur Mitteilung der Ergebnisse und den Umgang mit den dafür gewonnenen Untersuchungsmaterialien sowie den daran erhobenen genetischen Daten.

Abstract

The Human Genetic Examination Act (Genetic Diagnosis Act – GenDG) entered into force on 1 February, 2010. This act applies to genetic examinations and analyses for medical purposes, for those determining descent as well as in the insurance and employment sectors. The act regulates the duty to inform patients prior to genetic analysis and to obtain their informed consent, as well as the legal conditions of reporting the results of genetic examinations and analyses and handling of genetic data and genetic samples obtained thereby.
