15 Die Rhetorik anwaltlichen Wirkens

Abstract

When we talk about legal rhetoric, this term could simply imply lawyer’s rhetoric in the sense that the latter term has no distinguishing features in relation to the forementioned term. I will argue the opposite and picture lawyer’s rhetoric as a sub-discipline of legal rhetoric, emphasising its specific difference: the advocacy of clients’ interests. Furthermore I will ground my research on the traditional concept of rhetoric as speech, i.e. I will limit my scope primarily to the examination of oral forms of lawyer’s rhetoric: during conversations with clients, in contract negotiations and - of course - also in court. To scrutinize the characteristics of these speech situations in connection with their framework conditions as well as the entanglement of oral rhetoric with written forms of lawyer’s communication, with the role of the lawyer’s ethos and with a lawyer’s individual personality will be the aim of this article.
