9 Ethos und Pathos im Recht

Abstract

Ethos and pathos are classical modes of functioning of a legal discourse. In addition to the arguments (logos) ethos and pathos will help to convince the auditorium by highlighting the personal background of the author (ethos) andthe emotional affects of the audience (pathos). The modern rhetorical legal theory captures any situations and forms of making a legal opinion (speech, judgements, verdicts, et cetera). Hence we also have to consider the more social and psychological aspects of opinion making in all branches of the legal system and practice. The presentation of personality (ethos) aims for a personal appreciation of the author. A transfer of appreciation also takes place by citation of other acknowledged authorities of the legal system. Furthermore arguments by authority will show the open minded character of the author and his professionality. The instruments of expression to cause emotional affects of the audience (pathos) covers a sentimental wording, stylistic figures of language, images and metaphors. We should distinguish pathos of objectiveness and pathos of passion with which we seek to find acceptance by the audience. The strategical use of ethos and pathos will be assessed within a wide practical range.
