Abstract

This chapter analyses trends in education dispute resolution and rights redress, focusing on ‘alternative’ methods in the management of disputes between parents and educational and governmental authorities. It considers the implications of using alternatives to more ‘traditional’ (that is, formal-legal) adjudicative processes. It argues adopting methods such as mediation alters the form of dispute resolution, but not its essential character, which remains combative and narrowly focused, regardless of its social justice implications.
