Regulierung von Entgelten und Gebühren in Netzwirtschaften
Zusammenfassung
(Private und öffentliche) Monopole neigen zu Ineffizienzen. Im Rahmen des allgemeinen Kartellrechts und des sektorspezifischen Regulierungsrechts ist dafür Sorge getragen, dass solche Ineffizienzkosten auf die Verbraucher nicht übergewälzt werden können. Im vorliegenden Beitrag wird der Frage nachgegangen, ob auch das öffentlich-rechtliche Gebührenrecht einen vergleichbaren Schutzstandard gewährt. Darüber hinaus wird untersucht, ob die Vorschrift des § 130 Abs. 1 Satz 2 GWB, nach der sich die Kartellaufsicht nur auf privatrechtliche Entgelte, nicht aber auf öffentlich-rechtliche Gebühren erstreckt, von Verfassungs wegen Bestand hat.
Abstract
Regulation of private-law prices and of fees under public law in network industries
(Private and public) Monopolies tend to inefficiency. The supervision of cartels, on the basis of general cartel law as well as on the basis of specific regulatory law, has to save the consumer from the passing of costs of inefficiency on to him. The public law does not safeguard the consumer against exploitive fees. Indeed, the principle of efficiency is used not only in general cartel law and in specific regulatory law, but also in the law on fees. However, the term “costs” is inadequately determined. It is not regulated explicitly that costs of inefficiency cannot be shifted. Besides the law on fees does not regulate the methods to determine the costs (of efficiency). Finally the protection of the consumer against monopol profits by the supervision of local authorities is inadequate.
Section 130 para 1 sentence 2 GWB, according to which the supervision of cartels only extends to private-law prices, but not to fees under public law, violates the principle of equality (Article 3 para 1 GG) und is therefore unconstitutional.
