Serbian Contract Law: its development and the new Serbian Civil Code

The draft of the part on the law of obligations of the future Serbian Civil Code has recently been published, which includes new and revised rules on contract law. Through the process of adopting the new Serbian Civil Code, it can clearly be seen that Serbia faces two harmonisation challenges: the first being to reintegrate itself with other European civil law systems, while the second is to harmonise its national contract law with the latest developments of European Contract Law. In the first part of this article, I will examine the development and evolution of Serbian Contract Law, first evident in the first Serbian Civil Code of 1844. The second part of the article will deal with the contract law in the recently presented draft of the part of future Serbian Civil Code dealing with the law of obligations.
