European Company Law and the ECJ: The Court’s Judgements in the Years 2001 to 2004

Abstract
In recent years, the jurisdiction of the ECJ had deep impact on the company laws of the Member States. The following report summarizes the judgements of the years 2001–2004 which mainly focussed on the basic freedoms (freedom of establishment, free movement of capital). It will provide a learned analysis of the state of the art, particularly in the fields of relocation, taxation and “golden shares”. The text will draw references to literature from all over Europe and finish with a comprehensive list of paneuropean bibliography.
