Die Reihe „Forschungen zur byzantinischen Rechtsgeschichte" widmet sich der Überlieferung des byzantinischen Rechts mit dem Ziel, die Ergebnisse dieser Untersuchungen im Rahmen kritischer Editionen wie auch Monographien und Sammelbänden zu dokumentieren. Damit soll zugleich der mediävistischen Historiographie ein grundlegendes Hilfsmittel für eine erstrebte materielle Geschichte des byzantinischen Rechts bereitgestellt werden.

Volume 5 in this series

This volume contains all of Dieter Simon’s studies on the legal history of Greece, Rome and the Byzantine Empire. It contains texts on judgements, legal transactions, notarial forms, public law and constitutional law. The editions of newly discovered legal texts have been reviewed and corrected. All contributions have been revised and updated. The comprehensive study of early Byzantine jurists has not yet been published.

The Peira is a textbook. The author worked in 11th-century Constantinople for one of the highest judges at the court of the Byzantine emperor, whose verdicts he used to create a legal primer. He copied aphorisms and arguments, cited cases and laws. This provides us with a unique glimpse into the largely overlooked imperial Byzantine legal system. This volume contains a critical edition of the text, a translation into German, and a commentary.

The thirteenth volume of the Fontes Minores once again provides editions of texts and examinations of specific aspects of Byzantine legal history. Topics include sources for the conspiracy of Michael II against Emperor Leo V and Thessalonian jurisprudence in the Palaiologan age, but also the question of the reasons for studying Byzantine legal history.

The history of canon law in various Christian cultures (Latin, Greek, Syrian, Coptic) has, with good reason, mostly concentrated on questions of content and organization. In the present volume, however, a comparison is made of the procedures leading to conciliar decisions and thus to the emergence of canon law.

This book presents the first critical edition of the commentary on an early Byzantine canonical collection, the Synopsis Canonum. The author of the commentary was the most famous 12th century Byzantine legal scholar, Alexios Aristenos (pre 1100 – post 1166). The edition includes prolegomena and indices. The book offers insight on Byzantine legal history and will also be of interest to canon lawyers.
