The legal structure of civil litigation is tailored for the protection of individual interests. This causes inequalities in the access to court and the use of litigation. Special procedural forms for the collective enforcement of individual rights or the defense of common interests have been introduced to compensate for these inequalities. Have these collective procedural forms been effective? In order to answer that question different types of these procedures are described and available data concerning the actual use are analysed.

Zusammenfassung Ein zentraler Ort der Rechtsanwendung ist das Beratungsgespräch zwischen Rechtsanwalt und Klient. Dort wird ein spezifisches Klientenproblem seiner rechtlichen Lösung zugeführt. Der Prozeß der Rechtsanwendung wird nicht nur bestimmt durch die spezifische Fallproblematik, die rechtlichen Gegebenheiten und die anwaltliche Kompetenz, sondern auch durch die Art und Weise, in der Anwalt und Klient miteinander interagieren. Das berufliche Handeln des Anwalts manifestiert sich in der Interaktionssituation mit dem Klienten in Abhängigkeit von professionellen Standards, ökonomischen Zwängen, allgemeinen und beruflichen überzeugungen, Erfahrungen, Kenntnissen und Fähigkeiten. Für den anderen Mitgestalter der Interaktionssituation, den Klienten, stehen im Vordergrund seine Wünsche und seine Fähigkeiten, diese im Beratungsgespräch bei ungleicher Machtverteilung zur Geltung zu bringen; seine Wünsche und Zukunftspläne sind dabei Verarbeitungsformen seiner Problemsituation. Der vorliegende Beitrag versucht, diese Einflußgrößen präziser zu bestimmen und auf ihre möglichen Konsequenzen hin für die Interaktion selbst zu sondieren, indem Fragestellungen und Hypothesen zum Anwalt-Klienten-Verhältnis anhand der vorliegenden Literatur diskutiert werden. Resume A chief area of legal application is the lawyer-client consultation which imparts a legal solution to a specific problem of the client. The process of legal application is determined not only by the case in point, the legal factors and the competence of the lawyer, but also by the manner in which the lawyer and client interact. The professional performance of the lawyer with respect to his interaction with the client is influenced by professional standards, economic constraints, general and professional convictions, experiences, knowledge and capabilities. The client, as the other integral partner of the interaction, sees first and foremost his intentions and his ability to assert his intentions during the consultation in spite of his disadvantageous position; his intentions and plans are thus a means of coping with the problem at hand. This article attempts to define more precisely the extent to which these factors influence the interaction and to probe the possible consequences for the interaction by discussing the hypotheses and questions posed to the lawyer-client relationship in view of the literature on hand.
