Das subjektive Recht und der Wunsch nach Gerechtigkeit als sein Parasit / The Subjective Right as a Medium of the Self-Transformation of Society and Justice as its Parasite
Zusammenfassung
Die Systemtheorie unterschätzt die transsubjektive Leistung des subjektiven Rechts im Prozess der Selbstorganisation des Rechts zugunsten der „autologischen“ Verknüpfung von Entscheidungsoperationen. Jene besteht vor allem in der Erhaltung der „inneren Unruhe“, der Offenheit des „Variationspools“ der Relationierungsmöglichkeiten. Damit ist die Suche nach einer „Gerechtigkeit“, die von einem „Außen“ der Gesellschaft aus erfolgt, unvereinbar. Eine „Selbsttranszendierung“ des Rechts zur „Gerechtigkeit“ ist in den Grenzen der Eigenrationalität des Rechts nur in dem Sinne möglich, dass über eine „Meta-Regel“ die Vielfalt der Möglichkeiten gesteigert und Experimente mithilfe des „re-entry-Protokolls“ vorgenommen werden. Darüber könnte auch die Eröffnung einer „zweiten Chance“ im Anschluss an das Scheitern der Ausübung subjektiver Rechte ermöglicht werden.
Summary
Systems theory under-estimates the transsubjective role of subjective rights in the process of selforganisation of the law. Instead it focuses on the “autological” connection of the operations of decisionmaking. That role consists primarily in the preservation of an “internal unrest”, of the openness of the “pool of variety” of potential relationships. The search for “justice”, which proceeds from an “outside” of society, is incompatible with this role. A “self-transcending” of the law towards “justice” is only imaginable within the limits of rationality of the legal system in the sense of a “meta-rule” a multiplication of potential variations which allow for experiments with the help of the “re-entry-protocol”. The attribution of a “second chance” after a failing use of subjective rights might be possible.
