Atomised Losses in Tort Law: Conceptual Difficulties and Modern Developments

Abstract
This article provides a short introduction to the present special issue of the Journal of European Tort Law. After explaining the pertinent terminology of ‘atomised’ or ‘scattered’ losses and sketching out some examples, the author discusses procedural and substantive solutions to the problem and analyses them from a conceptual point of view.
