Spousal Agreements and Patriarchal Bargains: A Wife’s Guarantee of Her Husband’s Business Debts

Abstract
This Article uses the term patriarchal bargain in order to analyze spousal agreements. In her canonical article Deniz Kandiyoti has coined the term patriarchal bargain in order to describe how women negotiate with patriarchy and strategize under the constraints of male domination. Her seminal work has been highly influential in sociology and gender studies. However, legal scholarship has paid little attention to her work. This Article seeks to bridge this gap and explores how women bargain in the shadow of patriarchy. Using a European courts’ decision as an example, this article adds the patriarchal context of spousal agreements. This social context enriches our understanding of spousal agreements and deepens our understanding of contracting under conditions of social inequalities.
Résumé
Cet article utilise le terme de compromis patriarcal (« Patriarchal Bargain ») afin d’analyser les accords entre conjoints. Dans son article de référence, Deniz Kandiyoti avait forgé ce néologisme afin de décrire la manière dont les femmes négocient avec le patriarcat et élaborent des stratégies sous la contrainte de la domination masculine. Ses travaux précurseurs ont exercé une grande influence sur la sociologie et les études de genre. Cependant, les chercheurs en droit ont accordé peu d’attention à son travail. Cet article cherche à combler cette lacune et explore la manière dont les femmes négocient dans l’ombre du patriarcat. En utilisant une décision des tribunaux européens comme exemple, cet article introduit le contexte patriarcal des accords entre conjoints. Ce contexte social enrichit notre compréhension des accords entre conjoints et approfondit notre compréhension du fait de contracter à des conditions socialement déséquilibrées.
Zusammenfassung
In diesem Artikel wird der Begriff “patriarchal bargain” für die Analyse von Eheverträgen verwendet. In ihrem kanonischen Artikel hat Deniz Kandiyoti den Begriff patriarchal bargain geprägt, um zu beschreiben, wie Frauen mit dem Patriarchat verhandeln und unter den Zwängen der männlichen Vorherrschaft Strategien entwickeln. Ihr bahnbrechendes Werk hat in der Soziologie und der Geschlechterforschung großen Einfluss gehabt. In der Rechtswissenschaft wurde ihr Werk jedoch kaum beachtet. Der vorliegende Artikel versucht, diese Lücke zu schließen und untersucht, wie Frauen im Schatten des Patriarchats verhandeln. Am Beispiel einer Entscheidung eines europäischen Gerichts wird der patriarchalische Kontext von Eheverträgen dargestellt. Dieser soziale Kontext bereichert unser Verständnis von Eheverträgen und vertieft unser Verständnis von Vertragsabschlüssen unter den Bedingungen sozialer Ungleichheit.
