Abstract

This chapter deals with the comparison between global vessel sharing agreements and joint ventures in the container liner industry. Through the analysis of the key contracts framing the current shipping alliances, such as cooperative working agreements, we raise the question of their legal personality. As results, we show the contestable legal personality of these large entities, since they run their daily operations like joint ventures without the associated risks of joint liability and common ownership.
