Zusammenfassung

Kurz vor den Festtagen 2023 hat der EuGH die vorweihnachtliche Betriebsamkeit der sportkartellrechtlichen Gemeinde mit gleich drei Urteilen zum Zusammenspiel aus Sport und Kartellrecht noch erhöht. Neben dem auch in der Presse viel beachteten European Superleague-Verfahren (Rs C-333/21) ergingen Urteile zudem in den Verfahren International Skating Union (Rs C-124/21 P) und SA Royal Antwerp Football Club (Rs C-680/21). Die Entscheidungen haben weitreichende Implikationen, denen der vorliegende Beitrag nachspürt.

Abstract

The CJEU’s triple jump in sports antitrust law – European Superleague, International Skating Union and SA Royal Antwerp Football Club

Shortly before the 2023 festive season, the CJEU intensified the pre-Christmas excitement of the sports antitrust community with three long-awaited judgments on the interplay between sports and antitrust law. In addition to the European Superleague judgment (Case C-333/21), which attracted a lot of attention in the press, the CJEU also handed down its judgments in the International Skating Union (Case C-124/21 P) and SA Royal Antwerp Football Club (Case C-680/21) cases. In these judgments, the CJEU examined, inter alia, whether rules on approving new competitions were lawful under EU competition law (Articles 101 and 102 TFEU), why a distinction between restrictions by object and restrictions by effect is important for the justification of rules set by a sports association, when the Meca-Medina test applies, and what has to be taken into account for an exemption under Article 101(3) TFEU. The decisions have far-reaching implications, which are explored in this article.
