Will sustainability and environmental considerations be the next big hit for shaping the application of Article 102 TFEU?

Abstract

The German Federal Cartel Office’s (FCO) proceedings against Facebook have made big waves. The FCO used antitrust instruments, but based its action on a violation of data protection regulations. This action could serve as a blueprint for the violation of other non-competitive regulations, such as the violation of sustainability and environmental goals. This paper explores whether and how specifically Article 102 TFEU can serve in implementing sustainability and environmental considerations.

Abstract

Going “green” has become a common objective. Competition law has also recently become increasingly concerned with sustainability aspects. The discussions primarily revolve around Article 101 TFEU. At first glance, Article 102 TFEU offers less scope to take sustainability and environmental concerns into account than other areas of competition law. However, Article 102 TFEU has come into focus as a result of the Facebook case of the German Federal Cartel Office (FCO), which is now also concerning the ECJ. For the first time, the FCO has used competition law to enforce non-competitive objectives, in this case data protection law. In view of the current debate on climate protection, global warming and population growth, it is only a matter of time before Article 102 TFEU is used to enforce such objectives. The paper therefore examines whether and how Article 102 TFEU is useful for implementing sustainability goals.
