hammiṣwāh – a Forgotten Forerunner of the Deuteronomic Torah?

Abstract
Three orders of legal collections can be identified conceptually in the Pentateuch: hattôrāh, hāʽedut and hammiṣwāh. A comparison of their Greek textual and Masoretic vocalisation traditions can identify linguistic impulses that subordinate hāʽedut and hammiṣwāh to the legal system of the Dtn. hattôrāh. This article details why, in the Hellenistic period, hattôrāh could have emerged from a reframing of the pre-existing hammiṣwāh, which other textual witnesses confirm is older than hattôrāh.
Zusammenfassung
Im Pentateuch lassen sich drei Rechtssammlungen begrifflich identifizieren: hattôrāh, hāʽedut und hammiṣwāh. Ein Vergleich ihrer griechischen Text- und ihrer masoretischen Vokalisierungstradition kann sprachliche Impulse identifizieren, welche hāʽedut und hammiṣwāh rechtssystematisch der dtn. hattôrāh unterordnen. Es wird begründet, weshalb die dtn. hattôrāh in hellenistischer Zeit aus einem literarischen reframing der bereits vorhandenen hammiṣwāh hervorgegangen sein könnte, der andere Textzeugen ein höheres Alter bestätigen können als der dtn. hattôrāh.
Résumé
Dans le Pentateuque, trois collections de lois peuvent être identifiées conceptuellement : hattôrāh, hāʽedut et hammiṣwāh. Une comparaison de leur tradition textuelle grecque et de leur tradition de vocalisation massorétique peut identifier des éléments linguistiques qui subordonnent hāʽedut et hammiṣwāh à hattôrāh du Deutéronome. L’article montre pourquoi hattôrāh pourrait avoir émergé à l’époque hellénistique à partir d’une reformulation littéraire de hammiṣwāh, auquel d’autres témoins textuels peuvent appuyer une ancienneté supérieure à hattôrāh deutéronomique.
