The defendant’s position has been given short shrift in terms of its status, role, and function. As this work shows, the role of the defendant is not just one legal position among many but rather, a "systems issue" that touches upon and shapes the very foundations of criminal justice. The study sets the stage for a new fundamental debate about the grounds and limitations of accusation in German criminal proceedings.
