Objective
International Journal of Digital Law and Governance (IJDLG) is a fully peer-reviewed forum for theoretical and applied research in digital law and governance. The journal is international in scope, aiming to cover topics relating to digital law and governance throughout the world. Of particular interest is the interface between law and the following digital topics (but not limited to): cybercrime, cyber bullying, online harassment, online rumor and misinformation, information and data protection, virtual assets, digital governance, hacking, artificial intelligence, and technology and ethics. The journal analyzes the foregoing digital issues from a multidisciplinary perspective, drawing upon insights, concepts and theories from law, management, computer science, communication, economics, political science, and information science. The journal will be of interest to legal scholars, legal practitioners, government officials, data scientists, and digital engineer.

IJDLG is currently a Diamond Open Access journal fully funded by Zhejiang University.

Beyond the Unbalanced Scale: Re-Designing AI Collaboration in the Judiciary with Human-Centered Principles

Human-AI collaboration in the judiciary is widely regarded as a promising approach to reconcile efficiency with fairness, thus gradually gaining mainstream recognition. However, the current human-AI collaborative mode in the judicial domain remains an AI-oriented and unbalanced one, thereby limiting its capacity to achieve truly human-centric collaborative outcomes. This study constructs a specialized classification system for human-machine collaboration in the judicial domain, identifying three distinct collaborative modes: the Pipeline Mode, the Hybrid Mode, and the Augmented Mode. Grounded in this classification, the study reveals three forms of structural imbalance: information imbalance caused by system closure, communication imbalance caused by differences in decision-making methods, and dependency imbalance resulting from the disparity in computing capabilities. These imbalances help explain why existing collaborative arrangements frequently yield suboptimal results. Based on these findings, this paper proposes a set of human-centered collaborative principles and explores the inherent trade-offs among them. Furthermore, it also explores future research directions from three dimensions: human, technology, and norms, aiming to further enhance the application effectiveness of legal artificial intelligence and ensure that technology always serves judicial justice.

Algorithmic Accountability in Global Frameworks: A Comparative Discourse Analysis of Legal Constructs

This study investigated how algorithmic accountability is discursively framed across major global AI governance models, aiming to uncover how regulatory narratives shape legal responsibilities and power relations within the European Union, the United States, and ASEAN frameworks. A critical discourse analysis, combined with framing theory, was applied to three key instruments: the European Union Artificial Intelligence Act, Executive Order 14110 of October 30, 2023, and the ASEAN Guide on AI Governance and Ethics. The analysis revealed three distinct framings: the EU adopts a legal and rights-based approach, the U.S. relies on voluntary and innovation-driven standards, and ASEAN emphasizes ethical and cooperative responsibility. Common anchors such as transparency, explainability, and human oversight offer opportunities for regulatory convergence. Algorithmic accountability functions as both a regulatory mechanism and a discursive tool, reflecting divergent governance philosophies and geopolitical strategies. These narratives shape how AI accountability is defined, implemented, and contested globally. Policymakers, industry actors, and civil society should pursue adaptive and interoperable governance frameworks that strike a balance between legal enforcement, innovation, and ethical principles to strengthen global AI accountability.

International Transfers of Personal v. Non-Personal Data: Reconstructing the EU Legal Puzzle

Data has become a vital resource in the digital economy, offering firms a competitive advantage through access to large, accurate datasets, which are essential for personalisation, targeted advertising, and training AI models. This paper examines the evolution of the EU data acquis governing international data transfers, arguing that it pursues two interconnected objectives: promoting business-to-business data sharing to enhance EU competitiveness and ensuring high levels of personal data protection under the GDPR. It explores the tensions between these objectives by comparing the GDPR framework for personal data with the emerging rules for non-personal data under the Data Act and Data Governance Act. The paper highlights the blurred boundary between personal and non-personal data and the expanding ‘appropriate measures’ obligations under the GDPR, which collectively constrain economic operators’ ability to process data outside the EU, potentially limiting international data flows. In light of the European Commission’s Digital Omnibus proposal (November 2025) to simplify EU digital regulations, the paper concludes that while the proposal may reduce the dichotomy between personal and non-personal data, it retains distinct regimes for their international transfers. As a result, it does not resolve the complexities surrounding EU rules on international data transfers.
