Zusammenfassung

Der folgende Beitrag ist der Frage gewidmet, unter welchen Voraussetzungen die Kopplung der Vergabe von Außenwerberechten mit der Verpflichtung zur Ausstattung von Kommunen mit Stadtmöbeln zulässig ist. Im Vordergrund der Darstellung stehen Rechtsfragen des Vergaberechts und des Kartellrechts. Zudem wird auf notwendige Vorfragen des Öffentlichen Rechts eingegangen.

Abstract

The linking of outdoor advertising rights with the obligation to provide urban furniture in the light of Public procurement and Antitrust law

Aside from their procurement function, advertising usage contracts based on the compensation model also serve a financing function. The awarding of such contracts impacts various legal matters, including public law, public procurement law, and antitrust law. Public procurement law and antitrust law are in place to protect effective competition. Given this, it's not surprising that both bodies of law share structural parallels that are relevant in the current context. This is particularly evident in the obligation to award new contracts after a reasonably long amortization period, without renewing options. As holders of advertising rights and as procurers, municipal authorities play a crucial role in ensuring the transparency of the procurement procedures, their competitive design, and the equal treatment of providers. This should reassure stakeholders about the fairness of the process. However, as a manifestation of the guarantee of municipal self-government under Article 28 (2) of the Basic Law, they also have extensive discretion in the design of public spaces. Quality-related and, in particular, aesthetically justified objective requirements for the street furniture to be procured are permissible and, in principle, suitable to explain the different treatment of companies or their offers in individual cases.
