Phreatto – Ein Gerichtsverfahren zwischen Land und Meer für Athener mit ‚Vorstrafe‘

Zusammenfassung
Demosthenes, Aristoteles und Pausanias berichten von dem Dikasterion in Phreatto, zu dem ein außer Landes gegangener Athener auf einem Boot heranfährt, dieses unmittelbar an der Küste festmacht und sich dann in einem Prozess verteidigt. Er betritt zu keinem Zeitpunkt athenischen Boden, sondern bleibt auf dem Boot und vernimmt dort das Urteil, ob er vorsätzlich getötet hat oder nicht. Diese Verhandlungsform zwischen Land und Meer kann – so aufwendig und eigentümlich sie auch anmutet – durchaus historisch sein, ist aber nur zu begreifen, wenn man von Drakons Gesetz über die Tötung ausgeht. Der Gesetzgeber hat 621/620 v. Chr. den Vollzug der Blutrache unter die Kontrolle der athenischen Gemeinschaft gestellt und damit einen wichtigen Schritt zur Eindämmung von Konflikten in der Polis geleistet. Das Verfahren in Phreatto ist im Kontext dieser Verordnung zu betrachten.
Summary
Demosthenes, Aristotle, and Pausanias tell us about the Dikasterion in Phreatto, which an Athenian who has left the country approaches on a boat and then defends himself in a trial. At no time does he put his foot on Athenian soil, but remains on the boat, which he has anchored directly at the coast and hears the verdict about whether he has deliberately killed or not. Holding a trial between land and sea, however elaborate and specific, may be historically accurate but can only be understood in connection with Draco’s law on homicide. In 621/620 BC this legislator put the execution of the blood vengeance under the control of the Athenian community. This was an important step in containing conflicts in the Athenian polis. The procedure in Phreatto should be regarded in the context of this decree by Draco.
