Objective
The Law and Development Review (LDR) is distinguished from other law and economics journals in that its primary focus is the development aspects of international and domestic legal orders. Economic development concerns not only the interests of developing countries but also the economic future and the security of developed countries.

The journal helps exchange views globally on this important subject, particularly on the gap between the developed and developing worlds. LDR helps facilitate future global negotiations concerning the economic development of developing countries and sets out future directions for law and development studies.

The journal seeks top-quality articles on law and development issues broadly, particularly from the developing world as well as from the developed world. LDR’s editorial board includes top scholars and professionals from all parts of the developed and developing worlds.

The burgeoning field of quantum technologies presents a transformative landscape with profound implications for law and development. This abstract outlines some of the rising key issues at this critical intersection, highlighting the urgent need for interdisciplinary engagement and proactive policymaking. The unique characteristics of quantum technologies and related advancements are challenging the existing legal frameworks, particularly in intellectual property. Questions surrounding the patentability of quantum algorithms and hardware, the delicate balance between protecting innovation and fostering open access, and the potential for future patent disputes demand novel legal solutions. Ensuring equitable quantum disparities between developed and developing countries is paramount. Furthermore, the advent of quantum technologies poses a significant threat to current data security protocols. The potential to break existing encryption methods necessitates the rapid development and global adoption of postquantum cryptography. In addition, the societal and ethical implications of enhanced surveillance capabilities of quantum technologies require proactive and careful legal consideration within the privacy and civil liberties framework. Beyond security, there are fundamental ethical and societal considerations with emerging technologies. The dual-use nature of many quantum technologies raises concerns about their potential misuse. Addressing the law and development disparities inherent in this technological revolution is critical. Unequal access to research, funding, and infrastructure risks concentrating the benefits of quantum technologies in a select few nations. International collaborations, flourishing quantum ecosystem, and thoughtful technology transfer policies are essential to ensure that developing countries can participate in and benefit from this progress and enjoy these technologies to the fullest. Finally, the fast pace of innovation necessitates a reevaluation of existing regulatory challenges and innovation bottlenecks. Innovation and development should be fostered, not hindered by regulation. Adapting current legal frameworks and developing new regulations that balance fostering innovation with mitigating potential risks is crucial. There is a pressing need to create international legal standards and shared regulatory framework in the globally interconnected field of quantum technologies. In conclusion, the rise of quantum technologies presents a complex web of ethical, societal, economic, political, legal, and developmental challenges. Addressing these issues effectively requires proactive, collaborative efforts from legal scholars, policymakers, scientists, industry leaders, and the international community to ensure a future where quantum innovation contributes to equitable global development and operates within a robust and ethical legal framework.

The purpose of this article is to provide the appropriate policy framework to view the turmoil within which the U.S. economy exists after the start of the second Trump administration utilizing tariffs with no comprehension of their long-term impacts. By highlighting the current economic events and comparing the conditions with the fundamental principles of free trade, the article seeks to provide a convincing case for the complete rejection of isolationist and mercantilist tools. The article demonstrates that free trade between global states leads to increased competition and more efficient production. When the principles of free trade are properly implemented, consumers in the marketplace enjoy a greater variety of better-quality goods at a lower price, which is a win for the consumer. The concept of economic advantage leads to specialization in free trade economies, where a country only produces goods that they are efficient at producing resulting in higher levels of output in quantity and quality. When the principles of free trade are abandoned in favor of mercantilist and nationalist policies, other nations that relied on established free trade agreements seek other trading partners. The resulting impact to the transitioning economy away from free trade is chaotic at best and harmful for all of the economic participants. The first year of the second Trump administration can be best described as chaotic and detrimentally harmful to the United States’ interests and trading partners with no long-term plan for economic revitalization and prosperity.

Networks of Legal Integration and Development Outcomes in Post-Colonial Africa: An Analysis of Tax and Investment Treaties

Why has post-colonial Africa struggled to translate political independence into sustained economic development? This article argues that a critical but underappreciated factor is the structure of legal infrastructure connecting African economies to global capital markets. Conceptualizing law as economic infrastructure, we analyze how networks of bilateral tax and investment treaties allocate authority, shape interpretation, and enable enforcement of cross-border economic activity. Using network analysis, we show that Africa’s legal integration follows a U-shaped trajectory: high integration under colonial empires, sharp fragmentation after independence, and gradual reconstruction through bilateral treaties. Although treaty networks have expanded substantially since the 1970s, they reproduce hierarchical features of the colonial system through OECD-dominated model language and interpretive control. Within this networked hierarchy, certain jurisdictions – most notably Mauritius, the Netherlands, Belgium, and the United Arab Emirates – function as treaty hubs that bridge structural holes and expand African countries’ effective access to global investment networks. We provide empirical evidence that these network effects matter for development. An event-study analysis of 20 African countries adopting treaties with major hubs between 1990 and 2023 finds that GDP per capita rises by approximately 10–17 % within 3 to 5 years of adoption, with growth rates nearly doubling relative to preadoption trends. We find no evidence of adverse effects on poverty or maternal mortality. While causal inference is complicated by preexisting growth trends, the timing and magnitude of the effects are consistent with treaties amplifying development trajectories by reducing transaction costs and diversifying network access. The article contributes methodologically by applying network analysis to international legal infrastructure and substantively by reframing debates over tax and investment treaties. Rather than asking whether treaties are uniformly “good” or “bad” for development, we show that outcomes depend critically on network position, governance capacity, and access to rule-making institutions. The findings highlight both the developmental potential of treaty hubs and the missed opportunity of limited intra-African legal integration, with implications for Africa’s future strategies of economic and legal connectivity.

The 21st is the Urban Century. The world’s population reached 8 billion in November 2022, with over half (55 per cent) living in urban areas, a figure projected to rise to 70 per cent by 2050, and 85 % by 2100. And urban areas are the drivers of growth: according to the World Bank, cities account for more than 80 % of global GDP and nearly 90 % of private sector job creation. If economic, social, and human development throughout the world, and especially throughout the Global South, will occur, it will do so in cities and metropolitan areas. Yet cities are also legally and politically weak. They generally lack fiscal capacity and often the authority to regulate many of the most quintessential municipal affairs. Such legal fragility poses an enormous problem for development, for cities also face massive challenges: they are often cites of inequality and environmental destruction and lack both the power and accountability mechanisms to facilitate democracy. This Article considers the extent to which cities can contest their legal and political disempowerment through resort to the courts. Local governments often possess some sort of constitutional status, comprising both rights and (more often) responsibilities. What they often lack is leverage: national and state/provincial governments often have little incentive to cooperate with local governments in satisfying those obligations. But courts can change those incentives. This essay will consider the potential for litigation-driven local empowerment in two of the most important nations in the Global South: South Africa and India. In particular, this Article will focus on one policy area traditionally (although not exclusively) handled by local governments: water provision. The development of modern urban form required the provision of clean and sanitary water, and urban jurisdictions throughout the world early on assumed some responsibility for this service, whether through public ownership or public regulation of private ownership. Yet at the same time, water is crucial for agriculture, and indeed obviously for human life no matter where people live. Water law and policy thus clearly implicates the very heart of national economic and social development strategy. Excavating the fraught politics and technical issues surrounding water, therefore, serves as a prime area to demonstrate the power of local governments in development – or lack thereof.

Balancing Renewable Energy Deployment and Environmental Safeguards: A Legal Perspective from the EU and Italian Contexts

This essay addresses the political and legal question of how to implement European renewable energy policies in a constitutionally oriented manner without compromising the protection of the environment, the landscape, and fundamental rights in the name of the urgency of the “energy efficiency first” principle. It argues that the transition to renewable energy, despite a clear strategic choice by the European Union’s legislative policy in this direction, still requires “responsible acceleration.” The essay: in the Introduction, defines the subject and research question; in the first two paragraphs, proposes a reconstruction of the European regulatory framework in light of the principle of environmental and climate integration and the “energy efficiency first” principle; then proposes a comparison with the US experience in terms of competition between climate objectives and procedural guarantees highlighting the profoundly different approaches taken on the two continents; the analysis of the so-called proceduralization of energy and climate law will follow with reference to the problematic issue of landscape protection through an in-depth study of Italian implementation and the case of Sardinia, as an institutional and socio-economic stress test. Based on the argumentative path, the conclusion offers some summary reflections on a responsible acceleration of the climate-energy transition.

The (Un)Intended Consequences of South Korean Legal Education Reform

When identifying a legal solution to a problem, lawmakers will often draw from preexisting solutions from outside sources. Also referred to as ‘legal transplants,’ this was the approach taken by South Korean legislators when they sought to reform and modernize the nation’s legal education system. Named the Beophak jeonmun daehakwon seolchi unyeoung-e gwanhan beopruyl (referred to here as the “Korean Law School Act” or KLSA), this law marked the beginning of a three-year, full-time, graduate-level, professional law degree program in South Korea, modeled after the United States’ Juris Doctor (J.D.) degree program. Much of the existing literature evaluates the reform against its most visible ambitions: reducing legal education’s dependence on examinations, diversifying the legal profession, and making the curriculum more practice-oriented. On those terms, the record is mixed. However, legal transplant theory requires a more nuanced view. The KLSA successfully transplanted the organizational form of the American-style law school, but that form was reworked by Korean patterns of state oversight, exam-based status competition, and educational hierarchy. In this sense, the reform did not simply attempt to reproduce the U.S. model; rather, it produced a distinctly Korean version of it. The unintended consequences of the KLSA therefore illuminate not only the limits of legal transplant, but also the durability of local norms that structure legal education and the legal profession.

The New Development Brokers: The Implications of China’s Development Agenda for the Rule of Law in a Post-USAID World

Reductions in overseas development assistance among OECD countries have created a significant vacuum for development financing – one increasingly being filled by China. Amid shifting global power dynamics, this article critically analyzes how China’s position as the world’s largest creditor may impact the rule of law in recipient states. The article examines changes in the rule over time in the three largest recipients of Chinese development financing between 2000 and 2021 – Russia, Venezuela, and Pakistan. To trace developments in the rule of law in each of these three countries, the article disaggregates data from the World Justice Project (WJP) Rule of Law Index. The article finds that Chinese development financing is not correlated with improvements in rule of law performance. Rather all countries under examination experienced some degree of rule of law backsliding, with shifts in core indicators of authoritarian legality.

Thus, there is an urgent need for establishing robust legal frameworks that can safeguard residents’ rights and maximize developmental benefits. Hangzhou has implemented a sophisticated legal framework designed to guide the development of a smart city while trying to preserve residents’ other legitimate rights and interests. This article, therefore, explores the critical role of law in shaping the development of smart cities, using Hangzhou as a representative case study. By examining the economic, political, and social imperatives underlying Hangzhou’s regulatory model, this article investigates why the regulatory framework is designed in a particular manner and how it addresses the inherent tensions between innovation and regulation. Furthermore, in discussing the implications of Hangzhou’s regulatory model for other countries seeking to navigate the complexities of smart city development, this article contributes to the broader discourse on urban governance and legal innovation in the digital age, highlighting the transformative impact of law on the evolution of smart cities.

Legal and Policy Frameworks to Protect the Property Rights of Women Migrant Workers in Line with Agenda 2030: A Case Study of Uganda

Securing property rights for housing and land is crucial for promoting economic development, ensuring environmental sustainability, and maintaining social stability. Therefore, property law is significant to countries’ development agendas and to sustainability. With the externalization of labour, guaranteeing the rights of the more than 150 million women migrant workers (WMWs) is critical to ensure sustainability. Agenda 2030 recognizes that protecting migrant women’s rights will enhance their potential to become agents of development, which makes Sustainable Development Goals 1 (poverty), 5 (gender), 8 (labour), 10 (reduced inequalities), and 16 (rule of law) critical. WMWs actively contribute to their community, both financially and in-kind, and drive social change through exposure to diverse cultures. Remittances have become increasingly vital as a global source of external financing, and Uganda relies on them as a net recipient. Ugandan WMWs are vulnerable to exploitation and property deprivation, including remittances. In Uganda, their property rights, especially land, are affected by patriarchal systems, limited access to financial services, especially mobile money facilities, due to the deactivation of SIM cards during their absence, and illegal or extrajudicial deprivation of property, fraudulent transactions perpetrated by land grabbers, dishonest agents, trespass by squatters, and encroachment. Labour externalization organizations also exploit WMWs. This article examines the legal and policy framework applicable to communication, deprivation of property, access to land and financial services, anti-money laundering as they affect the rights of WMWs, with consideration of the nexus between property law and sustainability and how ownership of property affects decision-making for sustainability.

The Right to Sustainable Development Within African Continental Free Trade Agreement Crystallization, Creeping Codification and Localization

This article aims to elucidate the crystallisation of the right to sustainable development through the emergence of binding environmental and social provisions in African investment treaties concluded by Regional Economic Communities (RECs), which collectively constitute the normative components of this right as reflected in the AfCFTA. On the other hand, the articulation of the right to sustainable development in the AfCFTA investment protocol reflects a broader trend towards the progressive codification of this right throughout the AfCFTA agreement, which is designed as a single undertaking. As a result, the agreement imposes obligations on investors while affirming the rights of local communities. Thus, the AfCFTA framework actively engages investors’ responsibi’ity in protecting and promoting the right to sustainable development of local peoples and communities, thereby contributing to the localisation of the right to sustainable development. Moreover, the right of African States to regulate foreign investment, recognised as a principle of customary international law, has been established to safeguard environmental and social standards, notwithstanding the extensive protections afforded to investors under various investment treaties across the continent. The AfCFTA Agreement affirms the legitimacy of public policy objectives, particularly in guaranteeing the right to sustainable development for peoples and local communities. However, this normative ambition faces a significant challenge in the entrenched conventional protections accorded to foreign investors, and in the interpretative complexities surrounding investment treaties with respect to investor and investment protection.

Directors’ Duty of Care and Climate-Related Financial Disclosure: Navigating Australia’s Recent Reforms in Quest of Solving an Insoluble Conundrum

Science and technology are key driving forces behind change in modern society, influencing our expectations, politics, economy, and culture. A recent study by the World Health Organisation finds that nearly a quarter of global deaths – especially among children under five – stem from preventable environmental causes. On April 10, 2024, the Executive Secretary of the UNFCCC warns that the world has only 2 years to act decisively to prevent more severe climate consequences. Greenhouse gases trap heat in the Earth’s atmosphere, propelling global warming and climate change, which carry not only humanitarian but also serious financial consequences. The G20 nations and the Financial Stability Board, which monitors and makes recommendations about the global financial system, have highlighted climate change as a major threat to global financial stability. In response to the impending climate catastrophe, Australia enacted the Treasury Laws Amendment (Financial Market Infrastructure and Other Measures) Act 2024, requiring corporations to make mandatory climate-related financial disclosures. These reforms – which include, inter alia, a new legal duty imposed on company directors – are scheduled to be implemented in phases beginning in January 2025. This article analyzes how the directors’ duty of care and diligence aligns with their responsibilities to disclose climate-related information. Drawing on a doctrinal analysis methodology informed by archival sources, it also critically examines how the directors’ duty of care and diligence could be applied under Australia’s corporations law before and after the 2024 legislation, and how this statutory overhaul may influence legal reforms in other jurisdictions. The study concludes with its key findings and the broader policy implications. The legislative reforms may guide the shaping of climate-related disclosure law within the Asia–Pacific region.

International Investment Law and Sustainable Development – Friend or Foe?

Foreign direct investment (FDI) is widely regarded as a critical mechanism for achieving the Sustainable Development Goals (SDGs), yet the legal framework governing such investment often operates in tension with sustainability imperatives. This conference paper examines the complex relationship between international investment agreements (IIAs) and sustainable development and questions whether IIAs serve as instruments that promote or impede states’ pursuit of sustainability objectives. It argues that the structure and interpretation of IIAs, characterized by broad definitions and expansively worded standards of treatment as well as the use of investor–state dispute settlement (ISDS), have frequently constrained states’ regulatory autonomy, particularly in relation to sustainable development aims. Drawing on treaty practice and arbitral jurisprudence, the paper illustrates how these provisions have elevated investor protection over public welfare concerns and, in doing so, risk undermining the very goals that FDI is purported to advance. The analysis then turns to explicit sustainable developed-related provisions in IIAs − including right-to-regulate clauses, exceptions and carve-outs, investor obligations, and investment facilitation provisions − assessing their potential to reconcile investment protection with sustainable development. It concludes that meaningful alignment requires reconceptualizing IIAs as instruments explicitly designed to advance sustainability objectives rather than just vehicles for investor protection. This is the most promising path for transforming International Investment Law from a foe into a genuine friend of sustainable development.

A Legal Typology for Trade and Development in a Shifting Global Landscape

As the rules of the global trading system continue to undergo substantive and normative shifts, the future of trade and development hangs in the balance. Conflicting narratives and norms are challenging the foundation of trade and sustainable development at a critical time. Trade’s traditional focus on efficiency and liberalization has not left adequate room for economic and social development, equity, differentiation, and broad-based benefits. Efforts to make trade rules more sustainable and inclusive, however, have been criticized for lacking precision and impact, as growing nationalism, rising protectionism, and geopolitical tensions threaten to undermine the delicate balance of incremental progress. Studying and tailoring trade and development interventions based on social and distributional design features could deliver impact beyond high-level commitments and bridge these divides. Over the past several decades, sustainable development has been integrated into trade rules to varying degrees at the multilateral and regional levels. New legal instruments, particularly new regional trade agreement models, have expanded the connection between trade and a range of issues, including labor rights, environmental sustainability, Indigenous rights, and women’s economic empowerment. This trend, coupled with greater coordination at the multilateral level and a growing body of international soft law instruments, has also advanced new, more pluralistic legal models at a time when the multilateral system is under siege. These approaches are a notable step forward and could be expanded and adapted to better address distributional challenges. What is missing, however, is a road map on how to get there. This article addresses gaps in both scholarship and practice by combining a typology for comparing international legal instruments with more “micro” domestic and stakeholder-focused approaches. In doing so, it builds upon previous work to develop a functional and qualitative comparison of trade agreements and related areas of domestic law, incorporating a “micro international law” conceptual framework that assesses social and distributional aspects at a more granular and procedural level and places greater emphasis on stakeholder interests and input. This focus on the socio-legal and contextual dimension of trade and development, which is often largely overlooked or loosely relegated to domestic law, holds the possibility of identifying and diffusing legal innovation at the domestic and international levels to achieve non-economic goals. These dynamics are deserving of greater study, with trade agreements more carefully evaluated to avoid broad, aspirational constructions and domestic law assessed through a stakeholder-focused and procedural lens.

Chinese Law and Development (CLD): The Strategic Role of Nonlegal Norms in the Cross-Border Economic Order

Matthew S. Erie’s Chinese Law and Development (CLD) framework identifies nonlegal norms as instruments for risk mitigation in China’s transnational governance. However, the mechanism by which these norms transform into institutional effects remains underexplored. The present study contends that nonlegal norms – such as diplomatic mediation, overseas Chinese networks, and technical standards – function not as ancillary mechanisms but as strategic governance resources that generate quasi-legal order, institutionalize trust, and construct de facto regulatory frameworks. The paper puts forward a theoretical conversion mechanism that explains how nonlegal norms achieve normative effectiveness through practice rather than legal mandate. This conversion operates across three dimensions of nonlegal capital: relational capital, where diplomatic mediation transforms political authority into binding legal instruments, as demonstrated in the Malaysia East Coast Rail Link renegotiation (2018–2019); network capital, where social trust converts into institutional qualification, as exemplified by Robert Kuok’s appointment to Malaysia’s Council of Eminent Persons; and technical capital, where standards acquire regulatory force through adoption, as illustrated by the Ethiopia-Djibouti Railway’s embedding of Chinese specifications into African infrastructure. The theoretical contribution is threefold: extending the analytical scope of Law and Development, challenging legal centralism by demonstrating that effective governance emerges from normative synergy rather than legal primacy, and offering a hybrid governance model for understanding China’s cross-border engagement. The paper also addresses theoretical boundaries regarding legitimacy, accountability, and transferability, positioning CLD as a contextual analytical instrument rather than a universal paradigm.

Central Bank Digital Currencies (CBDCs) are being currently developed by most central banks in the world as a promising development mechanism: they may foster innovation in a somehow stagnant financial sector, stimulate diversification in products and services offered to consumers, and grant citizens broader access to sophisticated market products that are up to this moment available only to professional investors. All these potential benefits, however, come along with raising concerns. CBDCs are looked down by those who see relevant risks for data privacy. Critics also highlight the underpinning risks for financial stability, considering that radical changes in money issuance may affect the most prominent actors of the financial system – the banks, which may no longer play such a relevant role in the economic process. Though sometimes far-fetched, these issues are still relevant in the current debate. When supporters and critics brandish their perspectives in general terms, however, the high level of experimentalism involved in designing CBDCs is overlooked, in spite of its importance to understanding monetary innovation. This paper proposes a more empirical and less abstract approach to institutional aspects of CBDCs. The main goal of this work is to emphasize how official digital currencies should consider the regulatory framework under which they will effectively operate. This regulatory perspective reveals not only the varied legal landscape of official digital money but also how the potential contribution of CBDCs to development is conditioned by their institutional design, reflecting policy ambitions and also deep political and economic constraints. Within this empirical agenda, the paper analyzes one particular case of CBDC implementation, the Brazilian “Drex,” exploring its main strategic decisions as well as the policy choices for regulatory design.

The Dilemma of Bilateral Investment Treaty (BIT) in Times of Political Crises: The Application of the Russia-Ukraine BIT and its Implications on Interstate War

This paper navigates the legal challenges of BIT implementation during wartime by examining key dispute cases between Russia and Ukraine and aims to analyze the legal applicability of BIT in times of political crises, the necessity of such applications, and the feasibility of its implementation. The paper aims to clarify the legal basis for protecting foreign investments during political instability. Since Russia’s invasion of Ukraine, various investment disputes have arisen between the two countries. The cases involving Ukrainian investors and the Russian State share several common features that help analyze the role and impact of BITs and investor-state dispute settlement in political crisis situations. In terms of legal applicability, even in the absence of an explicit clause, conflict does not, in itself, suspend the treaty. Regarding necessity, upholding BIT can be considered in light of its core purpose of protecting investors, maintaining the rule of law, and preventing further political crises. In implementing BITs in crises, the political and economic feasibility must also be considered, with attention to procedural matters and the enforcement of arbitration awards.
