French Community Land Trusts and the Creation of the Bail Réel Solidaire (BRS): A Contractual Innovation Promoting Autonomy and the ‘Right to Housing’?

Abstract
This article examines the place of the Organisme de Foncier Solidaire – Bail Réel Solidaire (OFS–BRS) mechanism within the French legal framework for the right to housing. This scheme enables income-eligible households to access an innovative form of ‘homeownership’ at a lower cost. In French law, it is founded on a lease constituting real rights, the BRS, which establishes a contractual relationship between the household, holder of real rights over the dwelling, and the OFS, a non-profit organisation retaining full ownership of the land. The study traces the legislative evolution and gradual expansion of the mechanism. It then analyses the current legal structure of the BRS and its effects on the configuration of property rights, before exploring, from a normative perspective, the conception of the ‘right to housing’ embodied in this model.
Résumé
Cet article analyse la place du dispositif Organisme de Foncier Solidaire – Bail Réel Solidaire (OFS-BRS) dans le cadre juridique français du droit au logement. Ce mécanisme permet à des ménages sous conditions de ressources d’accéder, à moindre coût, à une forme inédite de ‘propriété’ immobilière. En droit français, il repose sur un bail constitutif de droits réels, le BRS, qui institue une relation contractuelle entre le ménage, titulaire de droits réels sur le logement, et l’OFS, organisme à but non lucratif conservant la pleine propriété du foncier. L’étude retrace l’évolution législative et l’élargissement progressif du dispositif. Elle examine ensuite la structure juridique actuelle du BRS et ses effets sur la configuration des droits de propriété, avant d’interroger, sur le plan normatif, la conception du ‘droit au logement’ que ce modèle met en œuvre.333
Zusammenfassung
Dieser Artikel untersucht die Stellung des Mechanismus des „Organisme de Foncier Solidaire – Bail Réel Solidaire“ (OFS–BRS) im französischen Rechtsrahmen des Rechts auf Wohnen. Dieses Modell ermöglicht einkommensberechtigten Haushalten den Zugang zu einer innovativen Form von ‚Wohneigentum‘ zu geringeren Kosten. Im französischen Recht basiert es auf einem Nutzungsrecht mit dinglicher Wirkung, dem sogenannten BRS, das eine vertragliche Beziehung zwischen dem Haushalt – Inhaber der dinglichen Rechte an der Wohnung – und dem OFS – einer gemeinnützigen Organisation, die das vollständige Eigentum am Grundstück behält – begründet. Die Analyse zeichnet die gesetzgeberische Entwicklung und die schrittweise Ausweitung des Mechanismus nach. Anschlieβend wird die aktuelle rechtliche Struktur des BRS und deren Auswirkungen auf die Ausgestaltung der Eigentumsrechte analysiert, bevor abschlieβend aus normativer Perspektive das im Modell verkörperte Verständnis des ‚Rechts auf Wohnen’ beleuchtet wird.
